Terms of Service
The terms that govern your use of the Brevard Ballet studio portal.

These Terms of Service ("Terms") are an agreement between you and Brevard Ballet, operating Brevard Ballet Academy and Brevard Ballet Youth Company (together, "Brevard Ballet," "we," "us," or "our"), and govern your use of the studio portal at portal.brevardballet.com and related services (the "Portal"). Please read them together with our Privacy Policy. By creating an account or using the Portal, you agree to these Terms. If you do not agree, do not use the Portal.
1. Who may use the Portal
You must be at least 18 years old and a parent or legal guardian (or authorized studio staff) to create an account. Guardians register and manage participation on behalf of their dancers, including any minors. If the studio issues a dancer a limited login, the responsible guardian remains accountable for its use and for these Terms. You confirm that the information you provide is accurate and that you are authorized to provide information about each dancer you add.
2. Your account
You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or close accounts that are inaccurate, misused, or used in violation of these Terms.
3. The service
The Portal lets families register dancers, enroll in classes and activities, review and sign studio agreements, receive communications, and view and pay invoices. Some actions — such as new-dancer placement or enrollment in certain classes — require studio review and approval, and a requested spot is not confirmed until the studio approves it or a waitlist spot opens.
4. Tuition, fees, and payments
- Charges. You agree to pay the tuition, fees, and other charges shown for the classes and activities in which your dancer is enrolled, under the billing plan you select (for example, pay in full or monthly).
- Payment methods. Online payments are processed by Stripe. By providing a payment method, you authorize us and Stripe to charge it for amounts you owe, including recurring tuition if you choose an automatic-payment (autopay) plan, until you cancel or change it in the Portal.
- Autopay. If you enable autopay, you authorize scheduled charges to your saved method for your balance on the recurring date shown, until you turn it off. You can manage saved methods and autopay in the Portal.
- Late and past-due balances. Overdue balances may incur late fees as disclosed by the studio, and continued past-due balances may restrict new registrations until they are resolved.
- Scholarships. Where a dancer's tuition is covered by a scholarship program, the studio records that payment and it is not billed to you.
- Taxes. You are responsible for any applicable taxes.
5. Refunds and cancellations
Registration fees, tuition, and other charges are subject to the studio's current refund and cancellation policy, which the studio will make available to you. Except as required by law or expressly stated in that policy, payments are non-refundable. Withdrawing a dancer does not automatically cancel amounts already due.
6. Guardian responsibilities
- Provide and keep current accurate dancer information, including health, allergy, medication, and emergency-contact details.
- Designate who is authorized to pick up a dancer and keep that list current.
- Review and comply with studio policies, handbooks, and the agreements you sign through the Portal.
- Ensure any dancer you register follows studio rules and conduct expectations.
7. Assumption of risk and release
Ballet and dance are physical activities that carry an inherent risk of injury. By enrolling a dancer, you acknowledge and accept these risks on your own behalf and on behalf of your dancer. You agree that participation is voluntary and, to the fullest extent permitted by law, you release and agree not to hold Brevard Ballet and its owners, staff, and instructors liable for injuries or losses arising from ordinary participation in studio activities, except to the extent caused by our gross negligence or willful misconduct. This Section does not limit any rights that cannot be waived under applicable law.
8. Photography and media
The studio may take or collect photos or video of classes, auditions, and performances, and dancers' headshots are used within the Portal for studio purposes such as rosters and casting. Any use of a dancer's image beyond internal studio operations is governed by the media or photo-consent terms the studio provides and that you agree to.
9. Communications
By using the Portal, you agree that we may contact you about your account and studio operations by email and, where you have consented, by text message. You can manage preferences and opt out of non-essential messages as described in our Privacy Policy. Message and data rates may apply.
10. Acceptable use
You agree not to:
- Use the Portal for any unlawful, harmful, or fraudulent purpose.
- Access accounts, records, or data that are not yours, or attempt to bypass security or access controls.
- Interfere with or disrupt the Portal or its infrastructure.
- Upload malicious code, or submit information you are not authorized to provide.
11. Intellectual property
The Portal, including its software, design, text, and logos, is owned by Brevard Ballet or its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Portal for its intended purpose. Information you submit remains yours; you grant us the rights needed to host and use it to provide the services.
12. Third-party services
The Portal relies on third-party services (such as our payment processor, hosting, email, and messaging providers). Your use of features that depend on them may also be subject to their terms, and we are not responsible for third-party services we do not control.
13. Disclaimers
The Portal is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Portal will be uninterrupted, error-free, or secure. Studio programs, schedules, staffing, and pricing may change.
14. Limitation of liability
To the fullest extent permitted by law, Brevard Ballet and its owners, staff, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or profits, arising out of or relating to your use of the Portal. To the fullest extent permitted by law, our total liability for any claim relating to the Portal will not exceed the amount you paid to us through the Portal in the twelve months before the event giving rise to the claim. Some limitations may not apply where prohibited by law.
15. Indemnification
You agree to indemnify and hold harmless Brevard Ballet and its owners and staff from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Portal, your violation of these Terms, or your violation of the rights of another.
16. Suspension and termination
You may stop using the Portal at any time. We may suspend or terminate access if you violate these Terms, to protect the Portal or others, or if required by law. Terms that by their nature should survive — such as payment obligations, disclaimers, limitations of liability, and the governing-law section — survive termination.
17. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree that any dispute relating to these Terms or the Portal will be brought exclusively in the state or federal courts located in Brevard County, Florida, and you consent to their jurisdiction, except where applicable law provides otherwise.
18. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the effective date above and, for material changes, provide a more prominent notice. Your continued use of the Portal after an update means you accept the revised Terms.
